A judge dismissed a wrongful death lawsuit filed by the family of Reagan Tokes against the Ohio Department of Rehabilitation and Correction in the Ohio Court of Claims in May, according to a report by 10TV.

Judge Patrick McGrath dismissed the lawsuit on Thursday after agreeing with ODRC that the rehabilitation center did not have any special duty to protect Tokes.

“Moreover, the court’s conclusion that DRC owed no duty in this instance is wholly consistent with the general principle that, absent a special relationship, there is no duty to control the conduct of a third person as to prevent the third person from causing physical harm to another,” McGrath said in the ruling obtained by 10TV.

The lawsuit came months after Brian Golsby was sentenced to life in prison for the kidnapping, rape and murder of Tokes back in February 2017. The prosecution had sought the death penalty for Golsby.
